Please read these terms carefully before using AfriStay.
Welcome to AfriStay. Thank you for visiting the AfriStay Platform (the "Platform"). By accessing or using the Platform, you agree to comply with and be bound by the following Terms of Use. Please read them carefully. If you do not agree with any of these terms, please do not use the Platform.
Words with capitalised initial letters have the meanings defined below. These definitions apply whether the terms appear in singular or plural form.
AfriStay LTD operates a digital hospitality platform at afristay.rw that connects Guests seeking accommodation with property Owners across Rwanda. AfriStay acts solely as an intermediary and facilitates the connection between Guests and Owners. AfriStay is not a party to any rental agreement entered into between a Guest and an Owner.
You must be at least 18 years old to create an Account, list a property, or make a Booking on the Platform. By using the Platform, you confirm that you meet this age requirement and that all information you provide is accurate, complete, and up to date. AfriStay reserves the right to suspend or terminate any Account where eligibility requirements are not met.
To access certain features of the Platform, you are required to create an Account. When you create an Account, you are responsible for:
AfriStay reserves the right to suspend or permanently terminate Accounts that violate these Terms, engage in fraudulent activity, or are found to be inactive for an extended period.
For Owners: By creating a Listing, you confirm that you have the legal right to list and rent the property, that all information provided is accurate and not misleading, and that the property complies with all applicable Rwandan laws and regulations, including any licensing or permit requirements for short-term rentals.
For Guests: You are responsible for reviewing the full details of a Listing, including description, house rules, availability, and pricing, before making a Booking. Once a Booking is confirmed, it is subject to the cancellation policy stated at the time of booking. AfriStay does not guarantee the accuracy of Listings and is not responsible for any discrepancies between a Listing and the actual property.
AfriStay facilitates the Booking process only. The rental agreement is solely between the Guest and the Owner. AfriStay is not liable for any disputes arising from the stay.
All payments for Bookings on the AfriStay Platform are processed externally through IremboPay, an independent payment platform. AfriStay does not collect, store, or process any payment card details, mobile money credentials, or other payment information.
When you click the payment link provided during the Booking process, you will be redirected to IremboPay's platform, which is governed by IremboPay's own terms and conditions. AfriStay is not responsible for any payment errors, failures, or disputes that occur on the IremboPay platform.
All prices displayed on the Platform are in Rwandan Francs (RWF) unless otherwise stated.
Cancellation policies are set by individual Owners and are displayed on each Listing before a Booking is confirmed. Guests are responsible for reviewing the applicable cancellation policy before completing a Booking. AfriStay is not responsible for administering refunds, which are subject to the cancellation policy agreed upon at the time of Booking and IremboPay's refund process.

AfriStay reserves the right to suspend or terminate the Account of any user found to be in violation of these prohibitions, without prior notice.
Guests and Owners may submit reviews following a completed Booking. Reviews must be honest, accurate, and based on genuine personal experience. AfriStay reserves the right to remove any content that is abusive, defamatory, discriminatory, or otherwise in violation of these Terms, without notice.
By submitting any content to the Platform, including reviews, listing descriptions, or images, you grant AfriStay a non-exclusive, royalty-free, worldwide licence to display, reproduce, and use that content on the Platform for the purposes of operating the service.
AfriStay makes reasonable efforts to maintain the security and integrity of the Platform. However, we cannot guarantee that the Platform is free from viruses or other harmful components. We strongly advise all users to run appropriate security software on their devices. AfriStay shall not be liable for any loss, disruption, or damage to your data or device arising from your use of the Platform.
The Platform may contain links to third-party websites, including IremboPay for payment processing. These links are provided for convenience only and do not constitute an endorsement of those sites. AfriStay has no control over the content, privacy policies, or practices of any third-party websites and assumes no responsibility for them. We strongly advise you to review the terms and privacy policies of any third-party site you visit.
The Platform is provided on an "as is" and "as available" basis without warranties of any kind, express or implied. AfriStay does not guarantee the accuracy, completeness, or reliability of any Listing, nor the conduct, suitability, or identity of any Guest or Owner.
To the maximum extent permitted by Rwandan law, AfriStay shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the Platform, including but not limited to loss of data, loss of revenue, or damage to property, even if AfriStay has been advised of the possibility of such damages.
AfriStay's total liability to you for any claim arising out of or relating to these Terms or your use of the Platform shall not exceed the amount paid by you for the specific Booking giving rise to the claim.
AfriStay may revise these Terms from time to time. When changes are made, we will post the updated Terms on this page and update the "Last updated" date. Where changes are material, we will notify registered users by email. By continuing to use the Platform after updated Terms take effect, you agree to be bound by the revised Terms. It is your responsibility to review these Terms periodically.
These Terms and any non-contractual obligations arising out of or in connection with them are governed by and construed in accordance with the laws of the Republic of Rwanda. Any dispute relating to or arising out of these Terms shall be subject to the exclusive jurisdiction of the courts of Rwanda.
